Definitions:

• (a) "Licensee" shall mean you, the purchaser and end-user of a Monica Moore Productions Package
• (b) "Monica Moore Productions product" shall mean the product, comprising of the rights to perform music and scripts, backing tracks, vocal tracks and the use of choreography, set design, costuming and staging ideas provided in the package
• (c) "Licensing agreement" shall refer to this document and confer a legally binding contract between the licensor (Monica Moore Productions) and the licensee (you).
• (d) "Monica Moore Productions" shall refer to the company with same name registered in New Zealand

1. Performance Rights

• (1a) Monica Moore Productions grants the licensee the right to perform the product purchased for  five performances over a period of 12 months from the date of purchase of the performance rights. An additional license must be purchased, should the licensee wish to perform any further shows. The licensee must contact Monica Moore Productions for further information on extending performance rights.
• (1b) This LICENSED product and all included documentation and cd's remain, in perpetuity, the sole and exclusive property of Monica Moore Productions. So that we may protect our intellectual property, the licensee agrees to comply with the following criteria:
• (1c) The licensee shall in no way reproduce any product purchased from Monica Moore Productions, nor shall the licensee, sub-license, on-sell, distribute, lend, give away, pass on, transfer any portion of a product purchased from Monica Moore Productions.
• (1d) The licensee shall be free to modify a product from Monica Moore Productions for their own use. The licensee is not permitted to resell or distribute a modified product from Monica Moore Productions. Any modifications made to a product from Monica Moore Productions must be minimal and superficial.
• (1e) The licensee shall not remove, alter or attempt to conceal in any way, the copyright notices found within a Monica Moore Productions product. Removal of copyright notices anywhere in a Monica Moore Productions product shall render your performance rights null and void.

2. Limitations of License:

• (2a) This product is LICENSED, not sold. While the licensee may keep the product, being the scripts and CD?s, performance rights are limited to the period stated in this agreement. (2b) We reserve the right to refuse sale or service to anyone for any reason not prohibited by law.

 3. Legal:

• (4a) Monica Moore Productions shall in no event be held liable to licensees of a Monica Moore Productions product for the content, quality, performance or any other aspect of any information provided by this product or for any errors in the transmission of such information. Nor is Monica Moore Productions responsible to any person or organisation for any damages arising in any manner out of the use of this product or the information contained therein. The licensees acknowledge that they assume all risk and responsibility for any losses or damage resulting from its use.

4. Indemnity

• (5a) The licensee shall indemnify and hold harmless Monica Moore Productions and its owners, agents and producers, from and against any claims, liabilities, losses, costs, damages or expenses (including attorney's fees) arising from the licensee's application of or use of the a Monica Moore Productions product.

You will need to agree to the terms of this license, you will be asked this before you purchase the Performance Rights and products of your choice.
